The "top" of the page may not be the place where the first heading appears. In such a case the Table of Contents is shown lower (when it is encouraged to appear to the right of the text). Thus the space where the content has been flowed around where the ToC should be is ignored and the ToC appears lower and is jumbled together with some of the content text. Work around by putting a heading at the top of the content.
TOC is inline, not a float.
